By accessing or using CaliforniaWarn (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

CaliforniaWarn provides informational workforce intelligence compiled from publicly available California WARN Act (Worker Adjustment and Retraining Notification) filings published by the California Employment Development Department (EDD).

The Service is provided for informational purposes only. It does not constitute legal advice, employment advice, financial advice, or any other form of professional advice. Users should consult appropriate professionals for specific guidance related to their circumstances.

3. Nature of Data

All layoff and workforce data displayed on the Service is derived from official WARN Act notices filed with the State of California. This information is a matter of public record and is republished here for convenience and analysis.

Predictive Intelligence: The Service includes AI-generated predictions for department names and hiring manager titles. These predictions are estimates based on publicly available information and company profiles. They are not verified facts and should be used as directional guidance only.

4. Payment and Access

Access to premium features requires a one-time payment processed securely through Stripe. Upon successful payment, you will receive immediate access to the full dataset.

Pricing: The current price is $99 USD for lifetime access to the premium dataset. Pricing is subject to change for future purchasers, but your access remains valid at the price you paid.

All Sales Final: Due to the digital nature of the product and the immediate delivery of access upon purchase, all sales are final and non-refundable. By completing your purchase, you acknowledge and accept this policy.

5. Permitted Use

Access to the Service is granted for personal or internal business use only. You may not:

  • Resell, redistribute, or sublicense access to the Service or its data
  • Use automated tools (bots, scrapers, crawlers) to extract or copy data from the Service
  • Modify, reverse engineer, or create derivative works based on the Service
  • Use the Service for any unlawful or fraudulent purpose
  • Share your access credentials with unauthorized third parties

Violation of these terms may result in immediate termination of access without refund.

6. Service Availability and Modifications

CaliforniaWarn may modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We do not guarantee:

  • Continuous or uninterrupted access to the Service
  • The accuracy, completeness, or timeliness of data displayed
  • That the Service will be free from errors, bugs, or security vulnerabilities

We strive to maintain accurate and up-to-date information, but we are not liable for any errors, omissions, or delays in data.

7. Intellectual Property

The Service's design, layout, compilation, organization, and presentation are protected by copyright and other intellectual property laws. While underlying WARN Act data is public record, our selection, arrangement, analysis, and predictive enhancements are proprietary.

You may not copy, reproduce, distribute, or create derivative works from the Service without explicit written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, that it will be error-free, or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALIFORNIAWARN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our total liability exceed the amount you paid for access to the Service.

10. Data Sources and Attribution

All WARN Act data is sourced from the California Employment Development Department (EDD) and is a matter of public record. We are not affiliated with, endorsed by, or sponsored by the State of California or any government agency.

11. Indemnification

You agree to indemnify and hold harmless CaliforniaWarn, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
